Privacy Policy for MommyKidz

Users of the MommyKidz app agree to the terms of this policy. If the Con User does not agree with the terms of this Policy, please do not proceed to use the MommyKidz App.
Please read the following terms of MommyKidz’s Privacy Policy:

1) COLLECTION OF PERSONALLY IDENTIFIABLE INFORMATION AND OTHER INFORMATION
1.1. ‘Personal Information’ means any information that can be used to identify or contact an individual. Such information that may be used for identification includes name, address, phone number, fax number, email address, financial profile, NID number, credit card information, gender, pregnancy etc.
1.2. When users use the MommyKidz app, users’ personal information is collected and stored which is provided by the user from time to time. In doing so, MommyKidz’s primary goal is to provide a safe, efficient, smooth and customised experience. It fulfills the needs of the users and makes the experience of using the app safer and easier.
1.3. Users acknowledge that in addition to their personal information, if they upload any content to the MommyKidz App in the form of reviews, recommendations, ratings, comments or otherwise, such content may require the provision of personal information. MommyKidz shall not be responsible for disclosure and dissemination of third party personal information by other users of the MommyKidz App.
1.4. Things like MommyKidz username, gender and pregnancy status may be disclosed in the MommyKidz app as aggregate information, but will never contain personal information. MommyKidz does not disclose personal information to third parties in the normal course of operations. When MommyKidz is legally obligated to disclose information to governments or other third parties, MommyKidz will do so.
1.5. MommyKidz implements standard measures to protect against unauthorised access and unlawful interception of personal information. However, no internet site or mobile based application can completely eliminate security risks.
1.6. User must submit required information while placing order on MommyKidz app. MommyKidz uses an online payment gateway operated by a third party and the information you share with MommyKidz is transferred and shared with such third party payment gateway operator.
1.7. Mobile device IDs (unique identifiers assigned to a device by the manufacturer) may be used instead of cookies to recognise the user when using the mobile application.
1.8. MommyKidz may collect information related to presence or absence on mobile phones or other applications The applications for which MommyKidz collects information may vary across categories, including, without limitation, shopping, fashion, food and travel. This will help better understand user preferences and enable personalised experiences
1.9. Highly sensitive information such as credit-card details are transacted on the secure sites of authorised payment gateways that are digitally encrypted, thereby providing the highest possible level of care as per current technology. However, users are advised that Internet technology is not 100% secure and should exercise discretion in using it

2) INFORMATION YOU PROVIDE TO US
2.1. Users’ Account Information: Users’ profile picture that will be publicly displayed as part of the account profile. Users may optionally provide information to MommyKidz through third-party sign-in services such as Facebook and Google Plus. In such cases, any information MommyKidz collects and stores through these sign-in services.
2.2. User Preferences: A list of user preferences and settings such as time, address and language.
2.3. User Content: Information that users provide through MommyKidz, including user reviews, photographs, comments, listings, current and past order details, etc.
2.4. User Searches and Other Activities: Search terms that users have viewed and selected results
2.5. User Browsing Information: How long the user has used the MommyKidz app and which features have been used and which ads have been viewed.
2.6. User Transaction Information: If the User makes a purchase or receives services through the MommyKidz App, MommyKidz may automatically fill out forms for future transactions, including (but not limited to) phone number, address, email to process User requests and collect and store information about the User.
2.7. User Public Posts: Users may provide information (such as ratings, reviews, tips, photos, comments, likes, bookmarks, friends, lists, etc.) to publicly accessible areas of MommyKidz to express opinions.
Users post and transmit information to publicly accessible areas of MommyKidz at their own risk. However, MommyKidz restricts access to certain areas. The user can set certain privacy settings for such information by logging into his account profile. But remember and be aware, because no security system is perfect or impenetrable. Additionally, MommyKidz cannot control the activities of other users of the App with whom you have shared your information.Information that may be displayed on the MommyKidz App, shared with businesses, and distributed to a wider audience through third-party sites or services, users should be careful not to disclose any sensitive information about themselves in such postings.
2.8. User health care: Anything stored in user health profile, test reports, prescriptions can be accessed to provide better advice and proper service.

3) LINKS TO THIRD PARTY PLATFORMS
3.1. The MommyKidz Website may contain links to other websites that are operated by third parties and are not controlled or authorized by MommyKidz or may not be expressly specified on the Website. MommyKidz is not responsible for any transmission received by the User from any Linked Site.Accordingly, MommyKidz does not represent any information regarding the privacy practices or policies of such third parties or the terms of such websites, nor does MommyKidz control or guarantee the accuracy, integrity or quality of information, data, text, software, photographs.
Information provided by the user to such third party websites will be governed by the privacy policies of such websites and it is recommended that you review the privacy policy of any such website before using such websites.These third-party websites and advertisers may use technology to send advertisements displayed on the website directly to the user’s browser.
In such cases, third-party websites or advertisers automatically receive your IP address. They may use cookies, JavaScript, web beacons and other technologies to measure the effectiveness of their advertising and to personalize advertising content.MommyKidz does not have access to or control over the cookies or other features that such third-party websites and advertisers may use, and the information practices of these third-party websites and advertisers are not covered by this Policy.

3.2. Email and Push Notification communication:
The following sets forth attribution notices for third party software that may be contained in portions of the MommyKidz App.
OneSignal Partnership Notwithstanding anything else in this policy, we may work with partners who use mobile SDKs, including the OneSignal Messaging SDK, to passively collect information (collectively, “SDK Information”), which generally helps us deliver personalized notifications. This data may also be used to identify you in a unique manner across other devices or browsers for the purposes of customizing ads or content. Depending on the permissions granted to this application, this information may include personally identifiable information (PII) including your email address. This information may also include precise location (i.e. GPS-level data) or WiFi information, apps you have installed and enabled, and your mobile identifier (e.g., Android Advertising ID).
Consumer Control & Opt-Out Options
a. Opting-out of OneSignal Push Notifications
You may in most cases opt out of receiving push notifications by going to your device “Settings” and clicking on “Notifications,” and then changing those settings for some or all of the apps on your device. (Different device configurations, or updates to devices, may affect or change how these settings work.)
b. Opting Out of “Cross-App” Advertising on Mobile Devices
You can opt out of having your mobile advertising identifiers used for certain types of interest-based (also called “cross-app”) mobile behavioral advertising, by accessing the “settings” on your Apple or Android mobile device, as follows: By opening the Google Settings app on your device, selecting Ads, and then selecting the option to opt-out of interest-based ads. (Different device configurations, or updates to devices, may affect or change how these settings work.)

4) COOKIES AND OTHER ELECTRONIC TOOLS
4.1 We and third parties with whom we partner may use cookies, pixel tags, web beacons, mobile device IDs, “flash cookies” and similar files or technologies to collect and store information about users’ use of the MommyKidz Web Platform. A cookie is a small text file stored on a user’s computer that enables us to recognize the user when he or she visits our website.
4.2. Third parties whose products or services are accessible or advertised through the MommyKidz web platform, including social media services, may also use cookies or similar tools and we advise users to check their privacy policies for information about their cookie and other practices. We do not control the practices of such partners and their privacy policies govern their interactions with customers.
4.3. If users post messages or comment on our message boards, chat rooms or other message areas, we collect information that users provide to us. We retain this information as necessary to resolve disputes, provide customer support and resolve issues as permitted by law.

5) USAGE OF INFORMATION WE COLLECT
5.1.MommyKidz may share personal information with other corporate entities and affiliates. These entities and affiliates may market to users as a result of such sharing unless the user expressly opts-out.
5.2. MommyKidz may disclose personal information to third parties. MommyKidz may require disclosure to provide users with access to the MommyKidz Platforms, to comply with legal obligations, to facilitate marketing and advertising activities, or to prevent, detect, mitigate and investigate fraudulent or illegal activity related to the MommyKidz App. User acknowledges that this disclosure is valid and consents to the disclosure.
5.3. MommyKidz may disclose personal information if required to do so by law or in good faith. Such disclosure is reasonably necessary to respond to a subpoena, court order or other legal process.
5.4. MommyKidz and MommyKidz affiliates may share/sell some or all of the user’s personal information with another business entity if MommyKidz plans to merge with or acquire that business entity or in the event of a business reorganization, merger, etc. The other business entity (or new combined entity) will be required to follow this Privacy Policy with respect to the user’s personal information in the event of such a transaction.
5.5. Information that MommyKidz collects from and about users is used by MommyKidz for a variety of purposes, including:

5.5.2. To understand users (what they do in the MommyKidz app, what features users like, how they use Cello, etc.)
5.5.3. To improve the content and features of the MommyKidz App (such as personalizing content of interest to users),
5.5.4. Initiating, completing transaction processes and showing special offers to users.
5.5.5. Administering the MommyKidz Services and diagnosing technical problems
5.5.6. Sending communications that the user has requested or may be of interest to.
5.5.7. If the User has registered on the MommyKidz App, sending the User questions from other Users that the User will be able to answer.
5.5.8. Being able to show ads relevant to users.
5.5.9. Generate reports, data, review and conduct research on the user base and usage patterns of the MommyKidz App.
5.5.10. Providing customer support to the user.
5.5.511. Providing notices about user accounts.
5.5.12. To carry out MommyKidz’s obligations, including billing and collection, and exercising rights arising from any agreement entered into between the User and MommyKidz.
5.5.13. Notifying User of changes to MommyKidz Services.
5.5.14. MommyKidz may use information to contact users about third-party products and services that may be of interest to users.

6) OUR DISCLOSURE OF YOUR INFORMATION
6.1. MommyKidz may disclose personal information that MommyKidz collects or that users provide, as described in this policy, in the following ways:

Social Networks: If users interact with social media features on the MommyKidz Platform, such as the Facebook Like button, or use social media credentials to log in or post content, these features may collect information about the user’s use of the MommyKidz Platform, as well as social media services. 7) ASSESSING, REVIEWING AND CHANGING YOUR PROFILE
7.1. MommyKidz will take reasonable steps to accurately record the personal information the User provides to MommyKidz and any subsequent updates.
7.2. MommyKidz encourages Users to review, update and correct the Personal Information that MommyKidz maintains about Users and Users may request deletion of such Personal Information about them.

8) SECURITY PRECAUTIONS
8.1. MommyKidz implements appropriate physical, electronic and managerial procedures to prevent unauthorized access to users’ information and to protect and assist in maintaining data security. These safeguards take into account the sensitivity of the information that MommyKidz collects, processes and stores and the current state of technology.Generally accepted industry standards are followed to protect personal information submitted to MommyKidz. However, no method of transmission or electronic storage over the Internet or mobile device is 100% secure.
8.2. MommyKidz assumes no responsibility or liability for the disclosure of users’ information due to errors in transmission, unauthorized third-party access, or other causes beyond MommyKidz’s control. The user plays an important role in protecting the user’s personal information. User must not share his username, password, or other security information of MommyKidz account with anyone.
8.3. Notwithstanding anything contained in this Policy or elsewhere, MommyKidz shall not be liable for any loss or misuse of User Personal Information, if such loss or misuse is attributable to a Force Majeure Event (as defined below).
8.4. A “Force Majeure Event” means any event beyond the reasonable control of MommyKidz and shall include, without limitation, sabotage, fire, flood, explosion, act of God, civil commotion, strike or any form of industrial action, riot, riot , war, government action, computer hacking, unauthorized access to computer data and storage devices, computer crashes, security and encryption breaches etc.

9) Changes to this Policy
MommyKidz reserves the right to revise this policy from time to time to reflect changes in laws, data collection and usage practices, features of the MommyKidz web platform, or advances in technology. If MommyKidz makes any material changes to this Policy, the changes will be posted on the MommyKidz web platform.

10) MommyKidz will keep users’ information for as long as MommyKidz has the user’s account. When the user terminates the account by contacting MommyKidz (the user cannot close their account), MommyKidz will cease to retain all information as stated in the Privacy Policy.

11) General provisions
By accessing the MommyKidz Platforms, the User agrees to the terms set forth in this Policy This policy should always be read along with the MommyKidz Web Platform Terms and Conditions of Use. Unless otherwise stated, the Policy applies to all information MommyKidz has about the User and their account.Any dispute arising under this policy shall be governed by the laws of Bangladesh and the courts of Dhaka shall have exclusive jurisdiction.
